Important Notice
All references to "Mohalla Medical", "we", "our" or "us" in this document refer to the brand operated by Vilki Pvt Ltd.
1. Seller (Medical Store) Registration & Obligations
1.1 Required Documents (Mandatory)
Sellers must provide the following documents during registration:
- Valid Drug License
- Contact number
- Physical address of the shop
- Picture of the shop premises
- Valid Email ID
1.2 Optional Documents (If Available)
Sellers may also provide:
- Food License
- GST Registration
1.3 Document Authenticity & Consequences
- All documents submitted must be valid and current.
- If any documents are found to be false, forged, expired, or misleading, the Seller shall be solely responsible.
- Mohalla Medical reserves the right to suspend or delete the Seller's account ("Seller ID") without prior notice in such cases.
1.4 Product Liability & Quality Assurance
- Sellers must comply with applicable laws, including but not limited to the Drugs & Cosmetics Act and the Pharmacy Act.
- Sellers must ensure correct labeling, expiry dates, batch numbers, and legal compliance.
- Any harm, damage, or mis-selling caused by defective, expired, or false products shall be the sole liability of the Seller.
- Mohalla Medical does not assume liability for the quality, efficacy, side effects, or compliance of the products.
1.5 Legal Compliance & Disputes
- Sellers must comply with all applicable statutory laws and regulations.
- Any legal disputes between Consumer and Seller shall be resolved through the Police Station and Courts in the Seller's registered city.
- Mohalla Medical may provide Seller's information/documents to law enforcement when required by law.
1.6 Payment Settlement
Payments for completed orders will be settled to the Seller within a minimum of 24 hours and a maximum of 7 calendar days, subject to Mohalla Medical's delivery/fulfillment confirmation or internal policy.
2. Consumer / Buyer Terms & Obligations
2.1 Platform Nature
- Mohalla Medical acts only as an intermediary marketplace (B2C), connecting Consumers with compliant Sellers.
- Only verified Sellers fulfilling government norms are onboarded.
2.2 Ordering via Prescription
- For prescription-based products, Consumers must provide a valid prescription from a recognized medical practitioner.
- Prescriptions may be verified by Sellers and/or Mohalla Medical.
2.3 Incorrect / Defective Products
- Consumers may lodge complaints for incorrect, damaged, expired, or materially different products.
- It is recommended to provide photo/video evidence (e.g., unboxing video).
2.4 Refund / Exchange Policy
- If the Consumer's complaint is validated, an exchange or full refund will be provided.
- If the complaint is unsubstantiated, deductions may be made for shipping/delivery charges as per policy.
2.5 Legal Liability
- Any legal claim due to defective or harmful products shall be directed against the Seller only.
- Mohalla Medical disclaims liability, acting solely as an intermediary.
- Jurisdiction lies in the Seller's registered city.
2.6 Prohibited Orders
- Consumers must not order illegal, controlled, or banned products.
- Violations may lead to legal action against both Consumer and Seller.
- Mohalla Medical may share Consumer data with authorities if legally required.
3. General Terms & Platform Liability
3.1 Role of Mohalla Medical
- Mohalla Medical does not manufacture, test, or own products.
- The platform only facilitates transactions between Consumers and Sellers.
3.2 Disclaimer of Warranties
- Platform, services, and content are provided "as is" without any warranty (express or implied).
- No guarantee of uninterrupted, error-free service is provided.
3.3 Limitation of Liability
Mohalla Medical, its officers, employees, or affiliates shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from platform use or transactions.
3.4 Termination / Suspension
Mohalla Medical reserves the right to suspend/terminate Sellers or Consumers for:
- Breach of terms
- Fraudulent activity
- Illegal behavior
- Requests from law enforcement
3.5 Changes to Terms
- Terms may be updated periodically.
- Notification will be provided via the platform or email. Continued use implies acceptance.
4. Payments, Prices & Taxes
- Prices displayed may include or exclude taxes, as indicated.
- Consumers are responsible for applicable taxes.
- Payment methods may include online payments, COD, wallets, or third-party gateways.
- Refunds will generally be made to the original payment method.
5. Intellectual Property
- All content (software, trademarks, text, images, etc.) belongs to or is licensed to Mohalla Medical.
- Users may not copy, reproduce, or distribute content without written permission.
6. Governing Law & Jurisdiction
- These Terms shall be governed by the laws of India.
- Courts in the city of Mohalla Medical's registered office shall have exclusive jurisdiction.
7. App Store / Play Store Compliance
- The app complies with Google Play Store and Apple App Store guidelines.
- All required disclaimers, licensing, verification, and prescription compliance will be enforced.
